BY ENTERING, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE SPONSOR, WHICH SHALL BE FINAL AND BINDING IN ALL RESPECTS. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

THESE SOLITAIRE CLASH SOCIAL EVENTS PROMOTION TERMS ("TERMS") ARE TO BE READ IN CONJUNCTION WITH AVIAGAMES' TERMS OF SERVICE AND OFFICIAL RULES. THE COLLECTION AND PROCESSING OF PERSONAL INFORMATION IS SUBJECT TO AVIAGAMES' PRIVACY POLICY.

IF THERE IS ANY INCONSISTENCY BETWEEN THESE PROMOTION TERMS AND THE AVIAGAMES' TERMS OF SERVICE OR THE AVIAGAMES' PRIVACY POLICY, THESE TERMS SHALL PREVAIL. FOR MATTERS NOT COVERED HEREIN, THE PROVISIONS OF THE TERMS OF SERVICE AND THE PRIVACY POLICY SHALL APPLY.

THIS PROMOTION IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK, INSTAGRAM, META, FIFA, or ADIDAS.

This Solitaire Clash Social Events Promotion ("Promotion") is open only to legal residents of jurisdictions in which Sponsor's game is legally offered and operated, who are eighteen (18) years of age or older as of the date of participation (each, an "Entrant"), excluding residents of Arkansas, Delaware, Louisiana, South Dakota, Michigan, Maine, Indiana, and any U.S. territories.

Employees, contractors, officers, and directors of AviaGames ("Sponsor"), and their respective parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment, and marketing agencies involved in the administration, development, fulfillment, or execution of this Promotion (collectively, the "Promotion Parties"), as well as immediate family members (spouse, parents, siblings, children, grandparents, grandchildren, and each of their respective spouses or "step" relations) and persons living in the same household of such individuals, are not eligible to participate or win.

Void where prohibited by law. All applicable federal, state, and local laws and regulations apply.

By participating in the Promotion, Entrants unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sponsor, including the interpretation of these Official Rules, administration of the Promotion, selection of winners, and Sponsor's exercise of discretion, which shall be final, non-appealable, and binding in all respects.

To enter the Promotion, eligible Entrants must complete the following steps: 

• Sign-in to their Facebook account (or create a free Facebook account if they do not already have one);
• Locate the applicable Promotion Post published by Sponsor;
• Follow the instructions stated in the applicable Promotion Post, including submitting a comment, screenshot, image, story, gameplay content, or other user-generated content ("Entry"); and
• Ensure that the Entrant's Facebook profile and submitted Entry remain publicly viewable for winner verification and communication purposes.

By completing the required steps above, Entrant will be able to enter into the applicable Promotion, subject to any limits stated in the applicable Promotion Post.

Note: 

Entries generated by script, macro, artificial intelligence automation, bot, programmed, robotic, or other automated means are void and may be disqualified.

Entries that are incomplete, illegible, corrupted, damaged, false, lost, late, misdirected, deceptive, or otherwise not in compliance with these Official Rules may be disqualified in Sponsor's sole and absolute discretion.

Sponsor is not responsible for technical difficulties of any kind, including the unavailability of Facebook, internet interruptions, platform outages, or failed transmissions.

Creating a Facebook account is free. By submitting your information and creating an account, Entrants agree to Facebook's applicable terms and privacy policies. If Entrant does not agree to Facebook's terms, Entrant cannot participate in the Promotion through that platform.

Message and data rates may apply when participating via mobile device.

By entering, Entrant acknowledges that Sponsor has no obligation to use, publish, repost, display, or otherwise exploit any Entry submitted.

By submitting an Entry, Entrant represents and warrants that:

• the Entry is Entrant's original work;
• the Entry has not been previously published or awarded;
• the Entry does not infringe the intellectual property, privacy, publicity, or other legal rights of any third party;
• Entrant has obtained all necessary permissions from any individual appearing in the Entry; and
• Sponsor's use of the Entry as contemplated herein will not violate any applicable law or third-party right.

Entries must comply with these Official Rules and Facebook's applicable community guidelines and terms of use.

As determined by Sponsor in its sole discretion, Entries may not:

• be sexually explicit, profane, obscene, hateful, defamatory, discriminatory, or excessively violent;
• promote illegal activity, unsafe conduct, weapons, drugs, tobacco, vaping products, or alcohol;
• contain unauthorized third-party trademarks, logos, copyrighted content, music, or branded materials;
• contain false, deceptive, or misleading statements;
• contain personal information such as addresses, phone numbers, or government identification numbers;
• impersonate any person or entity; or
• contain material inconsistent with Sponsor's positive brand image or goodwill.

Sponsor reserves the right to monitor, review, remove, reject, or disqualify any Entry at any time in its sole discretion.

Winners will be selected in the manner described in the applicable Promotion Post, which may include random drawing, judging criteria, community voting, gameplay performance, or a combination thereof.

Where judging applies, Entries may be evaluated based on factors including creativity, originality, relevance, entertainment value, quality, or community engagement, as determined by Sponsor in its sole discretion.

Where voting applies, Sponsor reserves the right to disregard fraudulent, automated, manipulated, or otherwise suspicious votes or engagement activity.

Sponsor's decisions regarding all matters relating to the Promotion are final and binding.

Odds of winning depend on the total number of eligible Entries received.

Potential winners may be notified by direct message, comment reply, email, or any other communication method that Sponsor reasonably believes will successfully contact the potential winner.

To claim a prize, a potential winner must respond within seventy-two (72) hours of Sponsor's initial notification and provide all information and documentation reasonably requested by Sponsor for prize fulfillment and eligibility verification.

If a potential winner fails to respond within the required seventy-two (72) hour period, fails to provide accurate or complete required information, or otherwise fails to comply with these Official Rules, such potential winner may be disqualified and shall forfeit the prize, and Sponsor may select an alternate winner in its sole discretion.

A potential winner becomes an official "Winner" only after verification of eligibility by Sponsor.

Prizes, prize quantities, and prize descriptions will be stated in the applicable Promotion Post.

Prizes may include autographed jerseys, promotional merchandise, gift cards, in-game promotional credits, bonus cash, or other rewards determined by Sponsor.

The retail value of each jersey prize is estimated at One Hundred U.S. Dollars ($100) and reflects unautographed merchandise only. The value of hand-signed merchandise is inherently subjective and may fluctuate based on the featured player, authentication status, market conditions, collectibility, and other factors at the time of prize award.

All prizes are awarded "AS IS" without warranty of any kind, express or implied. Prizes are non-transferable, non-refundable, and may not be redeemed for cash except at Sponsor's sole discretion.

Sponsor reserves the right to substitute a prize with one of equal or greater value if the advertised prize becomes unavailable.

Winners are solely responsible for any federal, state, or local taxes and any other costs associated with prize acceptance or use.

Limit one (1) prize per person unless otherwise specified by Sponsor.

Gift cards will be delivered electronically to the verified email address provided by the Winner. Delivery timeframes may vary depending on processing requirements and email service providers. Sponsor is not responsible for delivery delays, technical issues related to email delivery, invalid email addresses, blocked or filtered emails, or any other electronic delivery failures. Winners are solely responsible for ensuring that their email address is accurate, valid, and capable of receiving electronic communications from Sponsor.

Any Bonus Cash or in-game promotional credits will be delivered directly to the eligible game account associated with the UID provided by the Winner. Sponsor is not responsible for incorrect, incomplete, invalid, or inaccurate UID information submitted by a Winner.

Physical prizes, including jerseys and other merchandise, will be shipped to the mailing address provided by the verified Winner. Sponsor is not responsible for shipping delays, lost, stolen, damaged, undeliverable, or misdelivered packages caused by carriers, incorrect shipping information, or circumstances beyond Sponsor's reasonable control.

By submitting an Entry, Entrant hereby grants to Sponsor and its affiliates, successors, assigns, licensees, and designees a perpetual, worldwide, irrevocable, royalty-free, sublicensable, transferable right and license to use, reproduce, modify, adapt, publish, distribute, display, perform, create derivative works from, and otherwise exploit the Entry, in whole or in part, in any media now known or hereafter devised, for advertising, marketing, promotional, commercial, or operational purposes, without further notice, approval, or compensation except where prohibited by law.

Entrant further grants Sponsor the right to use Entrant's name, username, likeness, voice, image, biographical information, and statements in connection with the Promotion and related publicity.

All copyright, trademark, and other intellectual property rights in any advertising or promotional materials created by Sponsor incorporating the Entry shall be owned exclusively by Sponsor and/or its licensors.

Sponsor reserves the right, in its sole discretion, to modify, suspend, or terminate the Promotion should fraud, technical failures, unauthorized intervention, Force Majeure events, or any other factors impair the integrity, security, fairness, or proper administration of the Promotion.

Sponsor reserves the right to disqualify any individual found to be tampering with the entry process or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.

By participating, Entrants agree to release, discharge, indemnify, and hold harmless Sponsor, Facebook, Meta Platforms, and each of their respective affiliates, subsidiaries, officers, directors, employees, representatives, and agents from and against any and all claims, damages, liabilities, losses, costs, or expenses arising out of or related to:

• participation in the Promotion;
• the submission or use of any Entry;
• acceptance, possession, or use of any prize; or
• technical, administrative, or operational errors associated with the Promotion.

The Promotion Parties assume no responsibility for lost, late, incomplete, inaccurate, delayed, stolen, undelivered, or misdirected Entries or communications.

These Official Rules and the Promotion shall be governed by the laws of the State of California, without regard to conflict of law principles.

Entrants agree that:

• any disputes, claims, or causes of action arising out of or relating to the Promotion shall be individually resolved in binding arbitration per Section 15 of AviaGames' Terms of Service, without resort to any form of class, collective or representative action. 
• BY PARTICIPATING IN THIS PROMOTIONS, ENTRANTS FULLY AND UNCONDITIONALLY AGREE TO BE BOUND BY SECTION 15 OF AVIAGAMES' TERMS OF SERVICE WHICH IS INCORPORATED HEREIN BY REFERENCE WITH THE SAME FORCE AND EFFECT AS THOUGH FULLY SET FORTH HEREIN.
• any claims shall be resolved exclusively by binding arbitration; and
• Entrants waive all rights to punitive, incidental, consequential, or indirect damages, attorneys' fees, and any right to have damages multiplied or increased.

Except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a neutral arbitrator JAMS.

As a condition of entering the Promotion, each Entrant agrees that any personal information submitted in connection with the Promotion may be collected, processed, stored, and used by Sponsor for purposes of administering the Promotion and in accordance with Sponsor's Terms of Service and Privacy Policy.

In the event of any discrepancy between Sponsor's Privacy Policy and these Official Rules, these Official Rules shall govern solely with respect to the Promotion.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.

Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

In the event of any inconsistency between these Official Rules and any promotional materials, social media posts, or other statements relating to the Promotion, these Official Rules shall govern and control.
